クーリングオフって何？
クーリングオフとは
訪問販売や電話勧誘販売などで商品を購入する契約をしてしまった場合、消費者から解約することができる制度です。
特定商取引法などで定められています。
特定商取引法では、法律で決められた商品についての訪問販売、電話勧誘販売の場合、法律で決められた契約書を受け取った日を含めて原則として８日間、マルチ商法などの連鎖販売取引の場合は２０日間内に、消費者からの一方的な解約ができます。
エステティックサロン、外国語会話教室などの契約を店舗でしてしまった場合にもクーリングオフができます。
※ 解約の意思表示は証拠が残るように内容証明郵便で行いましょう。
販売会社だけでなく、信販会社・クレジット会社にも解約した旨を伝えましょう。
※ 契約書が法律で決められた条件をみたしていない場合には契約時から８日間をすぎてもクーリングオフできる可能性があります。
※ クーリングオフができないときでも、消費者契約法や民法などで取り消しができる場合がありますので、ご相談ください。
