不動産登記制度が変わりました
１．新しい不動産登記法の特徴
改正された不動産登記法は、片仮名の漢文体から、ひらがなの口語体になり、全く新しい法律のようになっていますが、やはり、条文を読んだだけではわかりにくいものです。
新しい不動産登記法の特徴は、
- インターネットを使って、オンラインで登記の申請ができること
- 登記済証（権利証などと呼ばれているもの）がなくなり、これに代わるものとして「登記識 別記号」という、１２桁のパスワードのようなものが、登記所から通知されること
- 間違いのない登記がされるように、登記の内容を証明する「登記原因証明情報」を必ず提出しなければならないこと
などです。
２．一部の登記所では、オンラインで登記申請ができるようになりました
一部の登記所では、自分のパソコンからインターネットで登記申請ができるようになりました。 オンライン申請をするためには、すべての資料を電子ファイルにしなければなりませんので、現在、紙の文書で作成していたもののいくつかは、電子文書にして、文書を作成した人の電子認証が必要になります。また、印鑑証明や住民票などは、申請する人の電子認証に変わります。 このことから、オンライン申請をするためには、少々やっかいな手順が必要ですが、やがて使いやすくなっていくのだと思います。
３．紙で申請する方法も残ります
オンライン申請が実施されても、紙で申請する方法も残ります。 また、現在は、申請する人かその代理人が、必ず登記所に出向いて申請しなければいけないのですが、新しい不動産登記では、郵送や信書便などを利用して、申請することもできるようになりました。 もっとも､登記所に提出する前の書類の紛失などについては、だれも補償してくれませんから、大事な書類の入った登記申請の場合は、登記所に出向いた方が良いかもしれません。
４．登記済証（権利証）がなくなります
これまでは、登記が終わると、登記所から登記済証（登記が完了したことを登記所が証明する文書）を渡されます。 この登記済証のうち、不動産を所有したときの登記済証が、一般的に「権利証」と呼ばれています。 「権利証」は法律上の名前ではありませんが、広く使われている呼び方です。（司法書士が、依頼者に所有権の登記済証を渡すときに、「登記済権利証」という題名の表紙を付けていることが多いようです。） 自分の不動産を売ったり、銀行の担保にするときに、「登記済証（権利証）」を登記所に提出する必要があります。 登記済証は、登記所から、自分の権利の登記をした者（またはその代理人）に渡されるものですから、権利者本人しか登記済証を持っていないはずなので、なりすましを防ぐことができると思われるからです。（実際には、借金の担保として、「登記済証」を他人に預けてしまうこともあるのも現実ですが、それだけ重要だということでしょう。） 「登記済証」は、登記上の権利者本人を確認するためのツールというわけです。 新しい不動産登記法では、その「登記済証（権利証）」が廃止され、別の方法で本人確認を行うことになりました。もっとも多くの登記所では、オンライン申請ができるようになるまでの間は、「登記済証（権利証）」が発行されます。少しばかりやっかいです。
５．「登記原因証明情報」が必要になりました
「登記原因証明情報」とは
登記原因証明情報は、登記をすることとなった理由がわかる書類や情報です。
書面で登記を申請するのなら、土地の「売買契約書」や代金を支払った「領収書」、銀行との「抵当権設定契約書」などがそれに当たります。
- 「登記原因証明情報」が必要なわけ（誤った登記をなくすため）
不動産登記は、土地や建物の所有権などの権利者が誰で、やどのような権利を持っているかなどを「公示」して、権利関係を明確にし、国民の権利を守っています。 そのために、誤った登記がなされないようにする必要があります。 登記をするときには、登記をすることとなった理由があります。 たとえば、土地を買ったとか、銀行のローンを組むときに、土地や建物を担保にしたなどということです。 新しい不動産登記法は、正しい登記をする方法として、登記所が、登記する理由を確認し、その証明する資料を保管することとしました。 この資料が、「登記原因証明情報」で、登記を申請するときには、必ず登記所に提出することとされました。 - どのようなものを作成しなければいけないのか
売買の契約書など、登記が必要となったことが記載された書類が「登記原因証明情報」に当たりますので、必ず新しく書類を作成するというものではありません。しかし、どの書類が「登記原因証明情報」として認められるかは、ケースバイケースなので、事前に登記所と相談する必要があるかも知れません。 司法書士が代理人となって、登記をすることとなったときは．契約関係などを確認してから申請するので、司法書士が「登記原因証明情報」を準備します。ですから、司法書士にご依頼されると、より確実で安全に登記ができることとなります。
６．オンライン申請は、いつ、どこから始まるのか
新しい不動産登記法は、本年（2005年）３月７日施行となりました。この日から、新しい方法による申請となりました。オンライン申請は、少し遅れて３月２２日から、「さいたま法務局上尾出張所」でスタートしました（いまのところ１カ所だけです）。
しばらく様子を見た後、順次全国の登記所でオンライン申請ができるようになるでしょう。
全ての登記所でオンライン申請できるようになるのは、４年ぐらいかかるかも知れませんので、しばらくは、オンライン申請ができるようになる登記所と、紙による申請だけの登記所の２種類の登記所ができることになります。
７．登記は国民のためのもの
不動産登記は、不動産の権利を護るためのもので、これを利用する国民の役に立つものでなければなりません。オンラインで申請ができるようになるのも、間違いのない登記をするために、「登記原因証明情報」を提供するのも、そのためです。
国は、今後も、責任をもって、国民が利用しやすくて役に立つ不動産登記となるように、改良していって欲しいものです。
登記の際に代理人となることが多い、私たち司法書士は、依頼者である皆様の利益を護るために精一杯の努力を続けていかなければならないと決意しています。
